1.1 The website OtticaAzzurroCapri.it has its registered office in OTTICA AZZURRO CAPRI | Eyewear boutique VAT number: IT06310531212. The use of the site by the User is subject to these conditions and access to the site presupposes recognition and acceptance of all the Conditions of Sale. OtticaAzzurroCapri.it does not provide guarantees of any kind (express or implicit) regarding the accuracy, completeness and reliability of the information, software, services and in general the content of the site, except for what is mandatorily established by the laws at consumer protection.
1.2 OtticaAzzurroCapri.it will be updated daily and expressly reserves the right to modify, in whole or in part, at any time and without notice, any part of the website.
1.3 The offer of products and services of OtticaAzzurroCapri.it is aimed at both consumer Users and other Users. By Users we mean subjects who purchase products or services presented on the site for purposes unrelated to any business or professional activity they may carry out in accordance with the provisions of the current decree.
2. SALES CONTRACT – PURCHASE OF PRODUCTS
2.1 The representation of the images of the products visible on the OtticaAzzurroCapri.it website generally corresponds to the photographic image of the same provided by the manufacturer or distributor with the sole purpose of presenting them for sale, without any guarantee or commitment, explicit or implicit on the part of OtticaAzzurroCapri.it regarding the exact correspondence of the image depicted on the site with the actual product, especially regarding the dimensions and/or chromatic aspects of the lenses and frames.
2.2 On each product page there is, in addition to the images, a description as detailed as possible regarding the color of the lenses and frames but in no way OtticaAzzurroCapri.it is responsible for what is described.
2.3 Each sale of products or services will be archived by OtticaAzzurroCapri.it through an electronic system and can be viewed, where necessary, both by OtticaAzzurroCapri.it staff and by any third parties that it uses for the execution of related services, shipments , invoicing, warehouse management.
3. PRICE AND AVAILABILITY OF PRODUCTS/SERVICES3.1 The prices published on each page of the OtticaAzzurroCapri.it website include VAT and any other legal obligations. The cost of each shipment (if applicable) must be added to the price of the individual product and/or service, the amount of which may vary based on the delivery and payment method, as well as in relation to the purchase price of the product.
3.2 For purchases of sunglasses for amounts exceeding €150.00, shipping is entirely the responsibility of OtticaAzzurroCapri.it. For purchases of contact lenses or accessories for amounts exceeding €69.00, shipping is paid entirely by OtticaAzzurroCapri.it. The total amount due for shipping will be clearly indicated and communicated to the Customer, before the conclusion of the Sales Contract (in the cart). In case of amounts lower than 150 euros (sunglasses) or 69.00 euros (contact lenses) the shipping price applied will be 5.99 euros.
3.3 The Prices shown on the Site are subject to possible variations and/or modifications by OtticaAzzurroCapri.it without any obligation to notify the Customer. These increases may depend - among others - on increases decided by the suppliers of OtticaAzzurroCapri.it. The price will remain the same as the order.
3.4 The availability of the products is subject to the availability of our central warehouse and the manufacturer. OtticaAzzurroCapri.it ships within 24/48 hours. Normally the products are available in 5-7 working days. Statistically, the order is shipped within 4 days (excluding some types of contact lenses). The order to the supplier is automatic but the delivery times of the distributors may exceed the contractually foreseen delivery terms. Each product purchased will be shipped with a regular sales invoice, CE guarantees from the manufacturer, 24-month warranty (for production defects), case of the purchased brand and microfibre/cleaning cloth (where applicable).
4. DELIVERY OF PRODUCTS
4.1 OtticaAzzurroCapri.it relies on express couriers such as DHL, UPS or Bartolini. When the order is processed by our warehouse and the courier takes charge of your delivery, 24 hours (working days) usually pass or a maximum of 48 hours for Italian destinations (maximum 3 days for Calabria, Sicily, Sardinia ). Product deliveries will take place during working days. It is possible to follow the progress of the package via the email you receive from the Bartolini courier after taking charge of the shipment. We would like to point out that NO COURIER MAKES preventive telephone calls and does not manage shipments that require particular times. Product deliveries will take place during working days from 9.00 am to 6.00 pm. From the moment Bartolini receives the email, thanks to the new service, you will be able to have an indication of the average time in which your package will be delivered in an average "time range" of 4 hours. (it is specified that this indication may exceed the times indicated due to problems related to previous deliveries or particular weather situations).
4.2 Communication of attempted delivery with GLS: in the event of non-delivery due to the absence of the recipient, an email or text message will be sent to the recipient with a timely communication which will contain the date for making the new delivery, normally scheduled for the following working day and the indicative time. By contacting the relevant branch you can agree on a different date or request an alternative address (subject to authorization from OtticaAzzurroCapri.it) or request collection at the branch.
4.3 Notification of non-delivery with UPS/DHL: the courier can leave a coupon in the mailbox or near the intercom where he communicates his passage and the non-delivery of the package. We recommend contacting the branch indicated on the coupon directly to arrange the next delivery.
4.4 Shipments returned to us after the storage period has expired will be subject to payment by the customer for the return of the goods.
4.5 The recipient of the package is invited to check and ensure its integrity immediately upon collection and in front of the courier who was responsible for delivery. No courier will check the contents of the package before signing for the delivery. If you are not the one collecting the package directly, please inform the person who will collect it.
5. PAYMENT METHODS

5.2 If you buy with Afterpay you receive your order immediately and pay in 3 instalments. You acknowledge that the installments will be transferred to Incremento SPV Srl, related parties and their transferees, and that you authorize such transfer.”,
6. RIGHT OF WITHDRAWAL – EXCHANGE OF GOODS
6.1 The Consumer has the right to withdraw from the purchase without any penalty and without specifying the reason. To this end, you must send a communication to the OtticaAzzurroCapri.it customer service at the email info@otticazzurrocapri.com presenting any explicit written declaration to be sent within 14 days of receiving the chosen products. The return of any item is accepted without hesitation, provided it is in PERFECT CONDITION and SEALED, FREE OF ANY TYPE OF WEAR, NEITHER RUINED OR SCRATCHED AND HAS THE WARRANTY SEAL INTACT.
THE WITHDRAWAL WILL ONLY BE VALID IF THE BUYER RECEIVES THE RETURN CONFIRMATION EMAIL; IF THE BUYER SHIP WITHOUT RETURN AUTHORIZATION THE GOODS WILL BE REFUSED.
6.2 The costs of returning the goods and/or requesting an exchange of goods will be borne by the consumer. In case of cancellation of the order before shipping the goods, the cost will still be charged to the consumer up to a maximum of €9.99. In the event that the seller sends goods that are different from what was ordered or with defects attributable to the production of the product, the shipping costs for the return of the goods and the new shipment will be borne by the seller. OtticaAzzurroCapri.it reserves the right to ask the consumer for evidence, including photographic evidence, to activate the seller's right to withdraw in any situation it deems appropriate. The Consumer is responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
6.3 OtticaAzzurroCapri.it will not be liable under any circumstances for damage, theft or loss of the returned items, until they have been returned. Any risk will therefore be borne exclusively by the customer. Please note that the items must be returned to the address provided via email by Customer Service. We recommend returning the item via tracked shipping. OtticaAzzurroCapri.it is not responsible for packages lost or damaged during return transit. Once the integrity of the returned product has been verified, OtticaAzzurroCapri.it will refund the amount paid by the customer no later than 14 days from receipt of the returned product using the same payment method as the consumer or alternatively by agreeing with the consumer for a refund by bank transfer without the consumer incurring any costs as a consequence of the refund. The right of withdrawal is not provided for the supply of sealed goods that are not suitable for return for hygienic reasons or related to health protection and specifically which have been opened after delivery (liquids or boxes of contact lenses).
6.4 OtticaAzzurroCapri.it in the case of special orders or requests to set aside a product for a certain period of time, provides for the return but the refund will be only and exclusively with a voucher of equal value to the amount paid.
7. PRIVACY POLICY
7.1 OtticaAzzurroCapri.it with registered office in Via Vittorio Emanuele, 38 80073 – Capri. creator and promoter of the activities provided on the site www.OtticaAzzurroCapri.it, reserves the right to use, in full compliance with current regulations (art. 13 et seq. Legislative Decree 196/2003), the personal data provided voluntarily by Users. Users are therefore invited to periodically visit this section to update themselves on changes relating to changes in current legislation. OtticaAzzurroCapri.it guarantees users that the processing of personal data will be reserved for uses strictly connected and related to the provision of its services, to facilitate the management of the site and the processing of orders. A representative will be at your complete disposal within the following 24/48 hours.
8. COMMUNICATIONS AND COMPLAINTS
8.1 All communications or any complaints against OtticaAzzurroCapri.it must be addressed to the Customer Assistance Service of OtticaAzzurroCapri.it, by filling in the appropriate forms on the site or by sending an email to the Customer Service.
9. COPYRIGHT AND TRADEMARKS
9.1 All contents, such as, by way of example, information, software programs, text, graphics and images, present on the Site are protected by copyright. Users are therefore expressly prohibited from modifying, distributing, transmitting, publishing, marketing, licensing, copying or using the contents for commercial purposes without the prior written consent of OtticaAzzurroCapri.it. All trademarks, logos and other distinctive signs of any kind used on the Site belong to OtticaAzzurroCapri.it and/or their respective owners. The use of the trademarks by the user is expressly prohibited, in any way and for any purpose, including reproduction on other websites, without the prior written authorization of OtticaAzzurroCapri.it or the legitimate owners. The images, descriptions, colors and all the technical details of each individual pair of glasses are purely indicative. OtticaAzzurroCapri.it reserves the right to update the site at any time without notice.
10. REFERENCE LEGISLATION - COMPETENT COURT
10.1 These General Conditions are governed by Italian law as well as each Sales Contract and subject to Italian jurisdiction. Any dispute relating to the General Conditions or the Sales Contracts will be the exclusive jurisdiction of the Court of Padua, without prejudice to the applicability of the mandatory provisions of law established to protect Consumers.
